You don’t necessarily need to follow a long procedure with formal warnings with a #capability dismissal, however the decision must be reasonable and the right to be accompanied and to appeal still apply #unfairdismissal #disabilitydiscrimination #hrtip

Make sure you consult employees you are considering dismissing for capability fully first, they may have ideas that could enable them to keep working #disability

When contemplating a #capability #dismissal for a #disability get as much medical and #employmentlaw advice as possible beforehand to protect your business #occupationalheatlh #disabilitydiscrimination #unfairdismissal #hrtip

Do you really need the qualifications you have asked for when recruiting? If you don’t, it may be #indirectdiscrimination so make sure you can justify anything you’re asking for #equalityact #hrtip

Changes to working hours or shifts may adversely affect women who are more likely to have caring responsibilities #indirectdiscrimination
